We ( “WithMe.ai”, “We”“Us”, or “Our”) operates the website (www.withmeai.com and all associated domains) and the WithMe mobile, web-based widget and online applications (“WithMe App” or “App/s” or “Mobile Software/s”). The AI self-care services, well-being self-care and therapist services, and web-based application services provided are collectively referred to as the "service(s)".







This page informs you of our policies regarding the collection, use, and disclosure of personal information when you use our service. We use your data to provide and improve the service. We will not use or share your data with anyone except as described in this Privacy Policy. We align our data protection practices to the key principles prescribed by GDPR and other Data Protection Laws.







This Policy applies to all visitors, data subject, and others who access the Service ("User(s)" or “You/r”). By using our Apps and services, you agree to the collection and use of information in accordance with this privacy policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service.

  1. WithMe well-being self-care service is a text-based or audio-video based messaging service. It will apply motivational interviewing and life self-caring to help you work towards your well-being goals. The 
  2. The service will focus on building wellness and emotional resilience. 
  3. The underlying principle of the well-being self-care service is that you have the knowledge and capacity to make desired changes in your life. The well-being self-care will support you in finding your own way and to help you tap your own strengths and abilities. This will help you identify and use resources around you to fill any gaps.
  1. The WithMe therapist service is a text-based or audio-video based messaging service. It will use person-centered supportive listening and motivational interviewing so that you can take control of your emotional well-being. It will use psychotherapy techniques to provide empathetic and non-judgmental support. The WithMe therapist will listen to your worries, promote positivity and support you in your lifestyle changes. 
  2. This will help you manage your situation better and build emotional resilience.


  1. WithMe mental health self-cares or therapists draw on various evidence-based psychological and lifestyle self-caring techniques to provide empathetic and non-judgmental support to help users strengthen their self-esteem and ace through emotional hurdles and current concerns to reach their goals. The service being offered is thus an enabling and empowering mode of support. If any user is found to need a diagnosis, treatment or any other regulated service, under our protocols, the mental health professionals focus on motivating them to seek out a locally licensed professional, and help them problem-solve around barriers to access.






  1. WithMe well-being self-care or WithMe therapist services do not replace face-to-face psychotherapy. It is meant to empower and support you and not to treat any illness or a health condition.
  1. The intended use for providing evidence-based tools and techniques is to manage emotions and encourage mental well-being in a self-help and self-monitoring context.
  1. The App is not intended to provide a diagnosis, prognosis, treatment or cure of a condition or disease.
  1. The App will not offer medical or clinical advice and only suggest that you seek medical help.
  1. Your data is stored in databases maintained by us and third parties located in countries other than your country of residence. Some of them may have data protection laws that may be less stringent than those in your country.






  1. The App and its services are primarily in the English and Chinese language. 
  1. The App aims to collect minimum personal data, for example, only username and password are required for register or login. No email, gender, age, social media access, phone number, biometrics data, special category data, etc. is asked.

1.     AI self-care is the text-based AI service provided in an conversational messaging mode by WithMe web-widget and mobile Apps.






2.     Cookie is a small amount of data stored on your device (mobile device).






3.     Data or Information under this Privacy Policy means both personal and non-personal data or information.






4.     Data Controller or Controller means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data.






5.     Data Processor or Processor or Service Providers means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the data controller.






6.     Data Protection Laws here means in accordance with reasonable security practices and procedures and sensitive personal data or data rules, including but not limited to requirements of EU General Data Protection Regulation 2016/679 (GDPR), the Indian Information Technology Act, Data Security Law of the PRC 2021, the UK Data Protection Act 2018 (UK GDPR), where applicable USA HIPAA and applicable Legal and Statutory requirements.






7.     Data Subject (or User/You) means any living individual who is using our service and is the subject of Personal Data






8.     Encryption is the process of transforming data into unreadable text so that it is only legible to those possessing an encryption key.






9.     Personal data or Personal Information means data about a living person who can be identified from the data and/or other information either in our possession or likely to come into our possession.






10.  Pseudonymization means the processing of personal data in such a manner that the personal data can no longer be attributed to a specific user without the use of additional information.






11.  Non-Personal data or Non-Personal Information means any data that is made anonymous and does not reveal user specific identity.






12.  Sub-Processor/s is a data processor who is sub-contracted some of the personal data processing.






13.  Special Category data includes personal data revealing or concerning racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic data, biometric data, data concerning health, sex-life or a person's sexual orientation.








Where we decide the purposes of our services and personal data processing, WithMe will be the Controller. For all services and data processing done at the direction of and on behalf of a Controller or a Processor, WithMe would either be a Processor or a Sub-Processor.



With the WithMe App you can chat through a conversational interface and get access to tools and techniques. You can also subscribe to a highly trained and qualified mental well-being professional. The App is available in iOS app stores, including a web-based AI self-care widget or application. Your interaction with the AI self-care is with an artificial intelligence system and not a human. The intended use of the App is for providing evidence-based tools and techniques to manage emotions and encourage mental well-being as an early intervention tool in a self-help context. Where WithMe is a Processor or Sub-Processor, the intended use of the App would be to provide the Institutional services and perform processing at the direction of the Institution (or Controllers). You make the choice of using the AI Self-care, based on your own estimate of need, and agree that this is only suitable for basic self-help and self-monitoring. This is not intended to be a replacement for face-to-face psychotherapy or to provide a diagnosis, treatment or cure for a disease or condition. The AI self-care cannot and will not offer advice on issues it does not recognize. Using the App, you can track and manage your mood, and learn context-sensitive evidence-based techniques that can help you feel better. The App and service is not intended for use in crisis or emergencies or severe mental health conditions. The App and service cannot and will not offer medical or clinical advice. It can only suggest that the user seek medical help.




At WithMe, we use proprietary Artificial Intelligence and Natural Language Processing/Understanding algorithms (“AI”) to understand your messages. Our values require that our AI used within the App is transparent, trusted, safe and privacy protecting. All the AI used in our Apps are “FIXED” or “CLOSED”. There are no generative (those that 'create' the response to the user on the fly) or adaptive models (those that continually adapt or learn every time on their own) in use. 

The primary purpose of the AI-based processing is

  1. to provide an interactive safe-by-design approach to converse and journal via text with the chatbot.




We only use your Personal data for the purposes for which we collected it. We will use it for another reason, only if compatible with the original purpose. We may process your personal data for more than one lawful basis depending on the specific purpose for which we are using your data. We may process your personal data without your knowledge and consent, where this is required or permitted by law.






The App does not process any data from your mobile device sensors, including accelerometer, ambient light readings, screen on/off readings and call logs. The App does not process your geolocation at a level that makes your data identifiable. The App does not process your country or state based on your time zone to provide you appropriate resources, such as scheduled reminders.






To provide you with our services, we use third party service providers to help store and process your data. We assess the service provider’s security and privacy practices. We strictly require that they comply with confidentiality and non-disclosure obligations and applicable laws and regulations including relevant Data Protection Laws. We also require that they access your data only to the extent necessary to perform tasks on our behalf. We use the following third party service providers.






Cloud Service Providers






To provide the service, we collect, transfer and store your data in secure servers provided by our authorized cloud service providers. You can find more on their security practices here, and here. We maintain a Data Processing Agreement (DPA) with Standard Contractual Clauses (SCCs) and Business Associate Agreement with our cloud service providers.







WithMe contains links to websites of other public and private organizations. When you follow a link to another site, you leave the WithMe site and your website interactions are no longer protected by our privacy policy. WithMe is not responsible for and does not endorse the privacy or security practices and content of sites to which WithMe links.








WithMe uses some social media tools and websites to interact with its customers and resource partners. Social media websites are used to publicize WithMe programs and services and engage with members of the public.






WithMe does not use third-party websites to solicit and collect personal information from individuals. Any personal information collected by a third-party website will not be transmitted to WithMe unless required for law enforcement purposes or as otherwise permitted by law. WithMe’s privacy and other web policies do not apply to these third-party sites and we encourage you to read the policies of the third-party site when deciding whether to use it.








For site security purposes and to ensure that this service remains available to all users, this system employs commercial software programs to monitor network traffic to identify unauthorized attempts to upload or change information, or otherwise cause damage.






For USA users, except for authorized law enforcement investigations, no attempts are made to identify individual users and their usage habits. Raw data logs are used for no other purposes and are scheduled for regular destruction in accordance with National Archives and Records Administration General Schedule 20.


For USA users, unauthorized attempts to upload information or change information on this service are strictly prohibited and may be punishable under thComputer Fraud and Abuse Act of 1986 and the National Information Infrastructure Protection Act.




For USA users, because we care about the safety and privacy of children online, we comply with the Children's Online Privacy Protection Act of 1998 (COPPA). COPPA and its accompanying regulations protect the privacy of children using the internet. WithMe does not knowingly contact or collect personal information from children under 13. WithMe is not intended to solicit information of any kind from children under 13.


It is possible that by fraud or deception we may receive information pertaining to children under 13. If we are notified of this, as soon as we verify the information, we will immediately obtain parental consent or otherwise delete the information from our servers. If you want to notify us of our receipt of information by children under 13, please do so by sending an email to info@withmeai.com.



WithMe provides interactive forms that let you voluntarily submit personal information. This occurs when you register to join an online community to submit information to web discussion forums, blogs and other community features, register to receive email updates and newsletters, and send questions and comments to the WithMe team. In these cases, all submitted information is used only for the express purposes for which it is provided and is not made available to any third party.





WithMe only shares information you voluntarily provide with other government agencies if required by law. WithMe never collects information or creates individual profiles for commercial marketing. However, when you join an online community and participate in online discussions, your name and other personal information you provide (except email) are viewable by anyone visiting WithMe, unless you choose not to share this information with the public on your user profile page. Any personal information you provide will be protected to the extent permissible under the Freedom of Information Act and Privacy Act.







For USA users, electronically submitted information is maintained and destroyed according to the principles of the Federal Records Act and the regulations and records schedules of the National Archives and Records Administration, and in some cases may be covered by the Privacy Act and subject to the Freedom of Information Act. SBA may also use online survey instruments to obtain feedback on your experience with WithMe. The survey initiation pops up for a random sample of visitors, is voluntary and does not collect personal information. If you decline the survey, you will still have access to the same information and WithMe resources as those who do take the survey. The survey reports are available only to WithMe managers and other staff who require this information to perform their duties. WithMe retains the data from the survey results in accordance with its data retention policy.
